Under Illinois law an injured person can receive compensation if it can be proven that the person who caused the accident was negligent and caused an injury. Immediately after being injured in an accident, the injured person becomes involved in an adversarial process. The insurance company of the negligent party has adjustors, investigators and attorneys working to minimize the amount the insurance company pays the injured person.

Many injured individuals fail to hire an attorney thinking they can handle the matter by themselves. The injured person thinks the negligent party's insurance will automatically pay their medical bills and lost wages. It's not that easy. The longer an injured person waits to hire an attorney, the more likely evidence will disappear or witnesses will forget important details. While treating for their injuries the insurance company's adjustors investigating the claim determine who was at fault. The insurance company is under no legal obligation to inform the injured person of their legal rights. Adjustors and attorneys attempt to find ways to pay as little as possible to maximize the insurance company's profits. Adjustors ask for recorded statements, which are admissible in court, from the injured party trying to get statements that will show the injured person was responsible or partially responsible for the accident.

  • Record important information about the accident, such as where it occurred, who was involved, and names of witnesses. If another person was involved in the accident, record their information too (name, address, phone number, insurance information).
  • Contact your insurance company.
  • If you are in an automobile accident, do not give a statement to the other party's insurance company until you have spoken to an attorney.
